To ensure there is no doubt, the possibility of patent applications being filed at the US Patent and Trademark Office (USPTO) is a problem. As of January, the number of unexplored applications reached a staggering and historic high, with 837,928 applications being unsubsidized and nearly 1.2 million pending applications. As of August, USPTO was able to reduce the number of unexplored applications to 800,559, a major improvement, but much work remains.
USPTO's pendance begins with the first touchpoint of the innovation process rather than just a backend prosecutor's matter. Small, AI-assisted changes to invention capture, advance triage, and claims strategies are useful and are becoming more and more needed as USPTO continues to implement the AI solutions themselves.
