Part 161, “Using Artificial Intelligence”: Implications for Lawyers Using AI and Generative AI

Part 161 became effective June 1cent and applies to all courts in the New York Unified Court System in both civil and criminal proceedings. This part allows judges, at their discretion, to introduce rules “governing the use of artificial intelligence tools by lawyers and parties in preparing documents submitted to the court.”
In this Lunch and Learn, we will examine section 161, consider what the implementing regulations are, consider the ethical obligations of lawyers when using AI and generative AI, and consider the range of sanctions that may be imposed if an application contains ‘hallucinations’.
