LINCOLN, Neb. (WOWT) – An Omaha lawyer accused of using AI to prepare state Supreme Court briefs should be temporarily suspended from practicing law, an attorney panel has recommended.
The Nebraska State Disciplinary Board is recommending the suspension of the law license of attorney Greg Lake, who filed a divorce case in Nebraska Supreme Court in February.
“And there were numerous errors in the brief submitted,” the judge said. “Could you please explain how that happened?”
“That’s exactly right, sir. It was my 10th wedding anniversary, and while I was on the plane, my computer crashed, and I uploaded the wrong version of the brief,” Lake said.
Lawyer denies use of AI at Supreme Court hearing
Opposing attorneys told the court that of the 63 references Greg Lake made in his brief, 57 involved some kind of issue.
“The brief that was submitted contained incorrect citations from cases, hypothetical cases, and erroneous citations from statutes. Perhaps in the version you submitted to us, how did all this come about?” the judge asked.
“For sure. It was a draft. And when I…my writing process is when I’m drafting, I stick with things that I know won’t pass muster,” Lake said.
“What’s important in this room is whether you used artificial intelligence. Did you?” the judge asked.
“No, I didn’t,” Lake said.
Lake repeatedly denied to a Nebraska Supreme Court judge that he had used AI. Judges last month dismissed his divorce appeal, saying his “argument that he simply submitted an incorrect draft… lacks credibility.”
Client faces large legal claim
Lake has one week to file an answer to the potential penalty before the Nebraska Supreme Court issues a final ruling.
Lake’s client in the divorce case is Jason Regan. Regan said she just received a $17,000 bill from the opposing attorney, which is due Friday, and that she owes an additional $35,000 in attorney fees for her former defendant.
He said he is exhausted and frustrated with the legal system as he struggles to keep his daughter alive, but isn’t sure he has the energy or financial resources to hire a malpractice attorney for another legal battle.
