Draft Presidential Regulation Regulating AI Use: Minister

JAKARTA (ANTARA) – Minister of Justice Supratman Andi Agtas said that the draft presidential regulation derived from Law No. 20 of 2025 on the Criminal Procedure Code will regulate the use of artificial intelligence (AI).

Agtas said that at a press conference in Jakarta on Monday (5 January), Deputy Minister Edward Omar Sharif Hiaryeh explained that electronic interrogation reports using AI could be applied during inspections to prevent intimidation and violence by investigators and other parties.

According to him, the use of AI will automatically input statements from interrogators and suspects, so all they need to do is sign them.

He further said that this would be regulated in the Draft Presidential Regulations on Information Technology-Based Criminal Justice System.

“We are preparing all these advances for implementation of the Criminal Procedure Code,” he said.

Previously, the Code of Criminal Procedure (KUHAP) was signed by President Prabowo Subianto and promulgated by Minister of State Prasetyo Hadi on December 17, 2025.

Pursuant to Public Law Section 369, this law is effective January 2, 2026.

On the other hand, Article 30 of the Public Law stipulates that the interrogation of a person suspected of committing a crime must be recorded using surveillance cameras during the interrogation.

Recordings can be used for investigation, prosecution, and defense purposes of suspects or defendants. However, further regulation must be provided in government regulations.
