Strike 3 Holdings, Companies that say they make “high quality”, “feminist” and “ethical” adult videos are suing Meta in federal courts in California to infringe copyrighted content and use it to train AI models. The complaint filed in July claims that Meta has torrentially seeded Strike 3 video since 2018. Details of related exhibits and complaints were not sealed last week.
Strike 3 argues that Meta's motivation is to get otherwise difficult visual angles, parts of the human body, and uninterrupted scenes (existing in mainstream films and television).
“They are interested in getting content because they can give them a competitive advantage over AI quality, fluidity and humanity,” argues Christian War, a lawyer for Strike 3.
The complaint also claims that Meta has been bit-rented and distributed 2,396 of Strike 3's copyrighted porn videos. That is, I downloaded and distributed large files using the BitTorrent protocol. Because BitTorrent does not have age verification, the process claims that Strike 3 porn videos can be accessed by minors. Meta continues to use “to distribute as currency to support downloading other content needed to train AI models”
The exhibit list includes titles that Meta allegedly got from a variety of non-porn sources, such as episodes. Yellowstone, Modern Family, Bachelor's Degree, South Park, and Downton Abbeyamong other mainstream television programs.
However, it also lists the titles of three porn videos that are not three porn videos that could include very young actors like: Exploitedteens, Anal Teens, Asian Teen Masturbation, Casualteensex, and Euroteenerotica. The list includes titles related to weapons, such as: 3D gun print and AR-15's Gun Digest Shooters Guide. It also has materials that are called Antifa's radical plan And ironically, Cyberspace intellectual property rights.
Matthew Thug, a law professor of artificial intelligence, machine learning and data science at Emory University, says using adult content as training data is a “public-reaction disaster waiting to occur.” Imagine middle schoolers asking meta AI models about videos about pizza delivery, he says, and before you know it, it's porn.
According to the lawsuit, Strike 3 says it “develops, owns and operates” an infringement detection system that will allow it to identify alleged meta violations. Based on the penalty for statutory infringement, the company is demanding $350 million.

The company's AI ambitions are epic and individually rooted. Zuckerberg publicly states that Meta “puts the power of super intelligence into people's hands and leads them towards something that cherishes it in their lives.” Meta's signature smart glasses are, for example, designed to give users a “personal closeness.”
