Supreme Court issues ‘alarming’ warning over use of AI in petition preparation, cites use of non-existent ‘mercy vs. humanity’ case

The Supreme Court on Tuesday, February 17, warned against the increasing use of artificial intelligence (AI) in petition preparation. It was discovered that AI was being used to draft the petition when the Supreme Court came across specific references to cases that either did not exist or were misquoted.

A bench of Chief Justice of India (CJI) Justice Surya Kant, Justice Joymalya Bagchi and Justice BV Nagaratna mentioned during the hearing that some lawyers have started using AI for drafting, Bar and Bench reported.

CJI Surya Kant said, “There have been alarming reports that some lawyers have started using AI for drafting. There was something about Justice Dipankar Dutta as well. All the precedents cited never existed.”

Justice BV Nagaratna recalled a non-existent case. “There was a case of Mercy vs. Humanity that didn’t exist,” he said, adding another such case and saying, “Some people are quoting actual Supreme Court precedent, but the portion cited doesn’t even exist in the text.”

The development comes weeks after the court assured judges that they would be very cautious about the use of AI and would not allow the technology to take over decision-making.

The Chief Justice said, “We are using this system in a very conscious way. We don’t want this to overwhelm the decision-making power of the judiciary. If we have a good proposal, we can give it to the executive.”

Meanwhile, Prime Minister Narendra Modi spoke of concerns about the potential for AI to disrupt the labor market, saying the central government was addressing this as an “immediate imperative” rather than a future problem.

In an interview with ANI, Prime Minister Modi said, “We understand the concerns of young people about AI disrupting the job market. The best antidote to fear is preparation. That’s why we have invested in upskilling and reskilling our workforce for an AI-driven future. Our government has launched one of the most ambitious upskilling initiatives in the world. We are not tackling this as a future problem, but as an immediate imperative.”

“History has proven that technology will not eliminate jobs. The nature of jobs will change and new types of jobs will be created. While some jobs may be redefined, the digital transformation will also add new technology-related jobs to the Indian economy. For centuries, there have been fears that innovation and technological revolutions will eliminate jobs. But history teaches us that with every innovation comes new opportunities. The same will be true in the age of AI,” the Prime Minister added.
