Thiruvananthapuram: The cyber wing of the Kerala Police has filed a complaint against social media platform
Police said in a statement that the alleged defamation was reported through official channels, including to the Election Commission of India (ECI).
“As a result of our review, it was determined that this content could mislead the public, undermine the credibility of constitutional institutions, and have a negative impact on the conduct of free and fair elections.”
Late on Wednesday night, a case was registered at the Thiruvananthapuram Cyber Crime Police Station against Lakshmi N. Raju (@valiant_Raju) and others (including X Company), and an investigation has been launched to ascertain who is responsible and take legal action, the paper said.
The FIR was lodged under Sections 352 (deliberate insult with intent to provoke breach of peace), 336 (forgery), 353 (remarks amounting to public mischief), 3(5) (common intention), 174 (punishment for undue influence or personality in elections) and 66C (identity theft) of the Bharatiya Janata Party. According to the FIR, the 1 minute 17 seconds long video was posted on social media platforms with the intention of causing riots in the society, and Company X allowed the video to be spread despite instructions from authorities to take it down.
Police said they have issued necessary legal notices to intermediary platforms under relevant provisions of the Information Technology Act and Rules for prompt removal of illegal content.
It further said that in accordance with the Model Code of Conduct and applicable legal provisions, the Kerala Police Cyber Operations Squad has immediately initiated steps to prevent further circulation of the video.
“The public is advised to exercise caution and refrain from creating, sharing or amplifying unverified or misleading content, especially during the election period,” police said.
He said swift, lawful and fair action would be taken against any activity that interferes with or attempts to influence free and fair elections.
