Netflix formalized its approach to artificial intelligence (AI) by publishing guidelines for media-creating partners. These guidelines aim to provide a framework for responsible and transparent use of AI tools in content creation for streaming platforms, providing an overview of acceptable parameters as Netflix increases its deployment of AI technology.
Accessed through Netflix's Partner Help Center, the newly released Generated AI Guidelines distinguish between low-risk and high-risk scenarios when integrating AI-powered tools or fully AI-generated content into media projects hosted on the platform. According to a report from The Lap, Netflix emphasizes that its primary purpose is to protect personal data, protect creative rights and maintain the trust of its established legal standards, respecters and audiences that apply to traditional content.
Netflix publicly states its perspective on the role of these technologies. “At Netflix, we consider these tools to be valuable creative aid when used transparently and responsibly,” the company said. The guidelines also address the ongoing discussion and demands from Hollywood trade unions regarding the use of AI. Netflix urges creative partners to ensure that AI implementation is no longer in place or substantially affecting the work normally performed by individuals represented by unions, including actors, writers, or crews, without proper approval or contract. The statement suggests that it is aware of the potential impact AI has on employment within the entertainment industry and its commitment to addressing labor concerns.
The core of the guidelines establishes specific criteria for determining the level of scrutiny required for generating AI use. This involves the process of escalating or “socializing” the use of AI, with the level of review being dependent on potential risks. Several important criteria have been outlined to manage this assessment.
- Copyright Compliance: Output generated by AI must not reproduce or substantially recreate the identifiable properties of materials that are owned or not copyrighted, nor infringe copyrighted work.
- Data Security: The generation tools employed must not store, reuse or train the input or output of production data, and must ensure the protection of sensitive information.
- Environmental Security: If feasible, you must use the generation tool within an enterprise-configured environment to protect input from unauthorized access or misuse.
- Material Persistence: The material produced is ideally temporary and should not be incorporated as part of the final deliverable, reducing the chances of unintended consequences and long-term risks.
- Talent Displacement: Generator AI should not be used to exchange or generate new talent performance or union-covered work without proper consent and compliance with existing contracts.
Netflix faced criticism in early 2024 following disclosure that the generator AI was used in a true crime documentary *. This instance brought scrutiny to the platform's approach to AI in documentary filmmaking. Additionally, Netflix has approved the use of generated AI in its post-apocalyptic original series *The Eternaut*. In this case, AI-powered tools replaced traditional visual effects (VFX) home work. Netflix CO-CEO Ted Sarandos commented that the decision has increased the speed by 10 times compared to traditional methods. *The Eternaut marked the first instance of the generated AI final footage contained in the Netflix original series or film.
In another development, Netflix is considering adding AI-generated ads to its lower-cost subscription tier. Netflix's advertising president characterized this potential move as a convergence of the company's entertainment and technical capabilities.
